The Application of EU Competition Law in the Energy Sector
Ulrich Scholz, Freshfields and Tim Vohwinkel, Freshfields examine The Application of EU Competition Law in the Energy Sector.
ABSTRACT: As the realisation of an Energy Union is a key priority for the Commission, it is preparing initiatives for the final implementation of an internal energy market, enhanced energy efficiency, and decarbonisation of the economy. In its State aid decision-making practice, the Commission has assessed endeavours of several Member States to integrate renewable energies in their energy markets and to implement so-called capacity mechanisms. In Eastern Europe, national regulators have maintained their focus on allegations of abusive behaviour by energy sector incumbents, whereas in other European countries, they appeared to turn their attention to other sectors.
